What Financial Orders Take Effect When a Divorce Is Filed?

In many Ohio counties, filing a divorce triggers standard orders that immediately restrict what both spouses can do with money and property. People are often surprised to learn these exist. Violating them, even unknowingly, starts the case with self-inflicted damage.



WHAT THESE ORDERS TYPICALLY COVER


Common restraints prohibit emptying or closing accounts, selling or hiding assets, running up unusual debt, canceling the other spouse's health or auto insurance, and removing the other spouse or children from coverage. The theme is simple: freeze the financial picture so the court can divide it fairly.



ORDINARY LIFE CONTINUES


These orders do not stop normal living. Groceries, the mortgage, tuition, and ordinary bills continue as before. What they stop is strategic repositioning: the account drained the week after filing, the truck sold to a brother for a dollar, the insurance quietly canceled.



IF YOUR SPOUSE VIOLATES THEM


Document it fast: statements, dates, amounts. Courts can hold violators in contempt, order money restored, and adjust the final division to account for what was moved. The paper trail is your remedy.
