Seelbaugh v. Montgomery Cty. Court of Common Pleas, Domestic Relations Div.
2025 - Ohio - 5297 (Dec. 2, 2025) (per curiam)
Holding. Objections to a magistrate’s contempt decision under Civ.R. 53(D)(3)(b), followed by appeal, are an adequate remedy that defeats prohibition, and a domestic relations division cannot be sued (¶ 8, 23-24). Trust-based sovereign-citizen arguments do not defeat jurisdiction (¶ 14).
Takeaways. A magistrate’s contempt decision is ordinarily challenged by objection and appeal, and a writ aimed at one may fail for that reason and for a misnamed respondent.
